Please, read the following entry carefully in its entirety. These terms apply to all users of Efashionbuyer.com,
including both registered and non-registered members, visiting guests, and shoppers.
All terms and conditions are effective as of November 1, 2009, for all existing and new users.
Efashionbuyer Defined
- Efashionbuyer is an internet wholesale shopping center, where qualified vendors can sell their products and qualified buyers can purchase them.
- Registered members are those who have applied for and have signed the Application form, and have been approved by Efashionbuyer. Anyone who has not completed the Application process will be considered a pending member, and not a registered member. Membership fees apply where necessary. Members include qualified buyers, manufacturers, and merchants.
- Qualified Buyers are those who currently own a business and a resale license, and do not have any delinquent history.
- Qualified Vendors are the merchants and manufacturers who own a business and a business license, and have no delinquent history.
- Users are those who visit, shop, and have or have not registered with Efashionbuyer. Anyone who accesses the Efashionbuyer website is considered its user.
Efashionbuyer Service Limitations
- Efashionbuyer will do its best to provide support for its members for issues related or regarding to the website up until the order process.
- The members, and not Efashionbuyer, are responsible for all issues that arise during and after the order process.
Membership Eligibility
- Qualified applicants will be at least 18 years old or older. Efashionbuyer does not allow vendors to sell its items to minors, and may terminate accounts or cancel orders to those of underage.
- Applicants must have a business license or resale license.
- Efashionbuyer may ask for applicants to go through background and/or credit checks. Any sign of delinquency or a criminal record can affect the applicant’s member approval.
Membership Registration
- All approved candidates must sign the Application form, thereby, agreeing with the Terms and Conditions listed in this Agreement and on the form.
Membership Cancellation/Termination
- Efashionbuyer can cancel or terminate memberships that violate the Terms and Conditions in this Agreement and the Application form, abuse an account, or use the website in any way that seems threatening to Efashionbuyer and its members.
- Members can cancel their accounts at any time, but early termination or other fees may apply where necessary.
Member Account
All members are responsible for protecting their own member ID and password. In addition, members are responsible for all activities that take place under the account and the computer used.
User Responsibilities:
In accordance with the terms and conditions of this Agreement, Efashionbuyer users agree not to:
- Use false information when using the website
- Infringe upon the rights of Efashionbuyer, its affiliates and users
- Violate any of the terms listed in this Agreement and the Application form
- Extract any information or data from the website
- Access the website for any illegal purposes
- Create multiple accounts under different aliases
Product Guarantee
- Products sold on Efashionbuyer.com are imported, manufactured, and/or distributed by the individual merchants and manufacturers. Products may vary to some extent from the images and descriptions provided by the distributor with the actual item. Typographical errors including, but not limited to, pricing, product description, and availability, may be present. Efashionbuyer does not guarantee the products displayed on the website and is not responsible in any way for such complications that arise from the use of its website.
Order Process
All buyers must provide the following information when purchasing an item from a vendor on Efashionbuyer.com:
Full Legal Name, Current Billing and Shipping Address, Phone Number, and Method of Payment
Vendors can cancel orders if:
- There is missing, false, or incorrect information provided.
- The buyer’s account has been showing delinquent activities.
Method of Payment
The method of payment requested may differ to some extent, depending on the vendor. Please, confirm with the vendor for specific instructions when purchasing an item from the website.
Order Confirmation / Cancellation / Change
- All issues relating or regarding the order process must be dealt with the vendor, and not Efashionbuyer.
- The buyer will be contacted by the product distributor to confirm an order.
- It is the buyer’s responsibility to inform the vendor immediately for any changes or cancellations made to all orders.
- Any changes or cancellations made to the order must be submitted before the item is shipped for the request to take effect.
Shipping
- It is the vendor’s responsibility to provide accurate information in regards to shipping method, pricing, method of payment, and delivery date. The vendor is responsible for any damages or delays that occur during the shipping process.
External Links
- Efashionbuyer can upload hyperlinks to other websites on its webpage, but is not responsible for any activity that occurs at the other locations.
Comments, Reviews, and Other Content
- The comments, reviews, and other content uploaded or written by the users on the Efashionbuyer website are the sole opinions of the users, and do not in any way represent Efashionbuyer. Efashionbuyer has the right to put down any content that seems illegal, obscene, or threatening to the website and its users.
Mailing
- Efashionbuyer will only contact its members with current website news through email if they have chosen that option during member registration.
Copyright & Trademark Ownership
- Efashionbuyer retains ownership of all original and edited artwork in photos, files, sites, buyer information, and all the contents published and hosted in and on its website.
- Duplicating and/or reselling these properties are illegal and will be prosecuted to the full extent of the law.
- Efashionbuyer has the right to edit and/or resell all the artwork on the website, including pictures users post on the site, without any notification.
- Users cannot resell or transfer the contract to a new owner or create any form of a third party recipient.
Disclaimers & Limited Liability
- Efashionbuyer is not responsible for any claims resulting from business activities between members or any third party.
- Efashionbuyer has the right to evaluate the members’ proper business manner if they fail to carry on the full extent of the contract and decide to terminate the contract.
- Users agree that they shall not hold Efashionbuyer liable for any incidental or consequential damages that arise from the website, regardless of whether such damages were caused by uncontrollable conflict (i.e. war, natural disaster, etc.), or intentional or negligent acts or omissions (server breakdown/maintenance, miscommunication, etc.) of Efashionbuyer or a third party.
- Efashionbuyer is not responsible if users post what can be inappropriate for the site or the pictures of counterfeit products or copyrighted products.
- Efashionbuyer may, at any time, perform either scheduled or unscheduled maintenance over its application and/or database servers, and is not responsible for any claims made by users occurring from the results of server maintenances.
- Efashionbuyer has the right to revise its policies at any time, and will post its revision with or without notice. It is the user’s responsibility to educate him/herself of all current policy matters.
- Users who continue use of the website once a revision has become effective will be considered as consenting to the amendments. It is the user’s responsibility to notify Efashionbuyer of its dissent to an amendment, and cancel the membership. Cancellation fees may apply where necessary.
Indemnification
- All users agree to indemnify and hold Efashionbuyer and its affiliates harmless of any legal fees or consequences that arise due to irresponsible use of the website, a breach of the User Agreement contract, or by violating the rights of a third party.
Conflict Resolution
- The user is responsible for reporting any conflicts that arise while using the Efashionbuyer website. Efashionbuyer agrees to resolve all conflicts that it is responsible for in a timely fashion. Efashionbuyer will take matters to court when necessary.
